New Regulations for Tourist Housing in the Valencian Community

Last August 2024, the DOGV published Decree Law 9/2024, of August 2, of the Consell, modifying the regulations governing housing for tourist use.

As the leasing of homes for tourist use is an economic activity of great importance for the entire Mediterranean coast, below we will detail the new features introduced by this new regulation for tourist homes located in the Valencian Community.

  1. This new regulation only modifies some points of the current regulations, which are Law 15/2018, of June 7, on tourism, leisure and hospitality of the Valencian Community, and Decree 10/2021, of January 22, of the Consell, which regulates tourist accommodation in the Valencian Community and also modifies Decree 10/2021, of January 22, of the Consell, which regulates Tourist Accommodation in the Valencian Community.
  2. For reasons of general interest, and applying their powers in the area of ​​urban planning, the Town Councils may establish proportionate limitations with regard to the maximum number of tourist dwellings per building, sector, area or zone. These limitations must obey clear and objective criteria, and must be duly publicised before their application. Therefore, the granting of Licences for Tourist Rentals will depend on the prior approval of the Town Council where the property is located, and the criteria may be different in each town, and provided that they are correctly justified within the urban planning.
  3. Tourist housing is understood to be that which is made available to users for a maximum period of 10 days, continuously and with the same guest. Therefore, rentals lasting 11 days or more are not governed by or subject to this regulation.
  4. Room rentals are not permitted in tourist accommodation.
  5. The registration of the Tourist Use home in the Tourism Registry of the Generalitat Valenciana will have a duration of 5 years, and which may be renewed during the month prior to the 5-year anniversary. 
  6. To renew Tourist Use Housing Licenses, the owner must submit a responsible declaration in the previous month and provide an updated Municipal Urban Compatibility Report. For those homes registered and with a Tourist License prior to the entry into force of this new law It will not be necessary to include a new updated Urban Compatibility Certificate in the renewal.
  7. Advertising for Tourist Accommodation must include the registration number and exact location.
  8. Tourist Use Homes must have internal regulations, which must include at least the rules for living together in the community where the property is located.
  9. Those homes for tourist use that at the time of publication of this regulation are already registered in the Tourism Registry after the entry into force of Law 15/2018, June 7, of the Generalitat, on tourism, leisure and hospitality of the Community, will maintain the validity of the registration for the exercise of the activity for a period of 5 years from the entry into force of this regulation, after which, they must submit a new responsible declaration of renewal.
  10. Minimum requirements for tourist accommodation:

 ACCESS AND COMMUNICATIONS

– Evacuation plan of the building at the door of the homes or, failing that, emergency instructions in several languages.

– Elevator (from number of floors Ground Floor + 4) (1)

– Entrance of clients, in the case of homes located on the ground floor.

– 24-hour telephone service.

FACILITIES AND SERVICES

– Power sockets in all rooms with voltage indicator (1).

- Hot water.

– Evacuation plan located at the door of the home.

– List of emergency and useful telephone numbers located in a visible place.

– Cooling at least in the living room-dining room or living room-dining room-kitchen.

– Heating at least in the living room-dining room or living room-dining room-kitchen.

– Internet connection, unless the home is located in a geographical area without coverage.

– First aid kit.

– Detailed information on the nearest medical center.

– List of emergency and useful telephone numbers.

– Reception service. Key delivery through boxes located on public roads is prohibited.

PROVISION OF HOUSING FOR TOURIST USE:

In general, the homes will be equipped with furniture, cutlery, household items, linens and other utensils and accessories necessary to meet the needs of the clients according to their capacity.

All bedrooms will be equipped with a wardrobe, inside or outside.

The homes will be equipped with internet access, except in areas without coverage, and a television.

The dwelling shall contain an automatic washing machine, unless it is located in a block or similar structure that has a communal laundry room that includes washing machines and dryers available to customers on the premises.

The kitchen will be equipped with at least the following elements:

– Refrigerator

– Electric iron

– Oven/microwave

– Extractor fan, hood, etc.

– Minimum of two electric burners when the dwelling does not exceed 4 people. For dwellings with 5 or more people, there must be three or more burners.
